कौटिल्य के 'अर्थशास्त्र' के अनुसार, मौर्यकालीन न्याय व्यवस्था में न्यायालय मुख्यतः दो प्रकार के थे-धर्मस्थीय तथा कंटकशोधन। धर्मस्थीय दीवानी तथा कंटकशोधन फौजदारी न्यायालय था। 'प्रदेष्टा' फौजदारी न्यायालय का न्यायाधीश तथा 'व्यावहारिक' दीवानी न्यायालय का न्यायाधीश था। कौटिल्य के 'अर्थशास्त्र' में उल्लेख है कि जो अमात्य 'धर्मोपधाशुद्ध' अर्थात धार्मिक प्रलोभन द्वारा शुद्ध चरित्र वाले सिद्ध होते थे, उन्हें ही न्यायाधीश बनाया जाता था।
