42वें संविधान संशोधन, 1976 द्वारा नीति निदेशक तत्वों के तहत अनुच्छेद 48क में राज्य के लिए पर्यावरण संरक्षण व संवर्धन तथा वन व वन्य जीवों की रक्षा का प्रावधान किया गया, और इसी संशोधन द्वारा मूल कर्तव्यों के तहत अनुच्छेद 51क(छ) में प्रत्येक नागरिक का यह कर्तव्य निर्धारित किया गया कि वह प्राकृतिक पर्यावरण की रक्षा और संवर्धन करे। अतः यह प्रावधान (a) और (b) दोनों में पाया जाता है।
