संविधान के अनुच्छेद 88 के अनुसार, प्रत्येक मंत्री तथा भारत के महान्यायवादी को संसद के किसी भी सदन की कार्यवाही में बोलने तथा भाग लेने का अधिकार है (चाहे वह किसी भी सदन का सदस्य हो), किंतु वह मतदान केवल उसी सदन में कर सकता है जिसका वह सदस्य है। अतः मंत्री जो राज्य सभा का सदस्य हो, लोक सभा की कार्यवाही में भाग ले सकता है।
