The provision regarding the composition of the State Legislative Council is laid down in Article 171 of the Indian Constitution. According to Article 171(1), the total number of members in the Legislative Council of a State shall not exceed one-third of the total number of members in the Legislative Assembly of that State, but shall in no case be less than 40.
